Most Do Qualify for a Discharge of Their Debt Under Chapter 7
The U.S. Bankruptcy laws provide a fresh start for individuals, families and businesses
who have found themselves in difficult times.  The time comes when all alternatives have
been tried and the only choice is to get a fresh start.
You do not lose your property in bankruptcy.  There are exemptions under the bankruptcy
laws that allow you to keep most, if not all of your property.  The amount of the
exemptions are different for the type of property that you own. A list of selected

Most, if not all of your debt, can be discharged in bankruptcy.  A list of the types of debt

non-dischargeable debt can be found here.
The great majority of those who have found themselves in a precarious financial situation
do qualify for debt relief under Chapter 7.  There is a Means Test Calculation that
determines whether individuals can discharge their debts under Chapter 7 rather than
entering into a repayment plan under Chapter 13.  If you make more than the median
income for your household size, there is a presumption that you should be repaying your
debts.  Even if you do make more than the median income for your household size, the
presumption can be overcome by a more detailed explanation of where your income is
going. The Means Test does not apply to those with primarily business debt. For more on
